Uslovi korišćenja

1. Vaše prihvatanje

Ovo je sporazum ("Sporazum") između Instituta BioSens ("BioSens"), vlasnika i operatera apv.biosense.rs, AgroSens APV softvera, AgroSens APV mobilnih aplikacija i Vas ("Vi" "Vaš", "korisnik“ ili „korisnici"), korisnika našeg sajta ili usluge. Kroz ovaj dokument, reči "BioSens", "mi", "nas" i "naši" se odnose na nas, BioSens Institut, našu veb lokaciju AgroSens APV.rs i apv.biosense.rs ("Sajt" ili "Usluga"), ili našu aplikaciju AgroSens ("Aplikacija"), u zavisnosti od toga kako je prikladno u kontekstu korišćenja reči.

Molimo pročitajte Uslove korišćenja usluge i Politiku privatnosti pre korišćenja našeg sajta i usluge. Ovaj sporazum je pravno obavezujući i uređuje vašu upotrebu naše aplikacije, sajta i usluga. Korišćenjem ili pristupom bilo kom delu našeg Sajta ili Usluga slažete se da ćete biti obavezani ovim Uslovima korišćenja i Politikom privatnosti.

S vremena na vreme možemo izmeniti uslove korišćenja usluge ili politiku privatnosti i tražimo od vas da proverite ovu stranicu jer se ovaj sporazum ili naša Politika privatnosti možda promenila. Vaša dalja upotreba naše aplikacije, sajta ili usluge predstavljaće potvrdu i saglasnost za sve izmene načinjene u okviru Politike privatnosti i Uslova korišćenja usluge.

Ako se ne slažete sa Uslovima usluge ili politikom privatnosti, odmah prekinite korišćenje našeg sajta i usluge.

2. Opis servisa AgroSens APV

AgroSens APV pruža onlajn i mobilne alate za poljoprivrednike, poljoprivredna preduzeća, vladine institucije i organe i akademske i istraživačke institucije koje se bave poljoprivredom. Obezbeđujemo vođenje evidencije, praćenje bez papira i obrađene snimke satelita Sentinel. Pored toga, pružamo alate za vizuelizaciju podataka, vremensku prognozu i razne dodatne informacije namenjene boljem i efikasnijem upravljanju poljoprivrednim operacijama.

3. Definicije

U tekstu ovog Sporazuma, možemo koristiti određene reči ili fraze, čije značenje je važno da razumete. Lista data dole nije sveobuhvatna i nijednu definiciju ne treba smatrati obavezujućom na način koji obesmišljuje ovaj sporazum:

"Sporazum" označava ove uslove usluge;

"Aplikacija" označava aplikaciju AgroSens APV za mobilne uređaje koju možemo staviti na raspolaganje putem našeg Sajta ili prodavnice aplikacija u vlasništvu trećih lica ili koja nudi slične karakteristike onima dostupnim na našem sajtu;

"Usluga" se odnosi na usluge koje pružamo preko naše stranice, kao i na bilo koji Softver i našu Aplikaciju;

"Sajt" se odnosi na našu internet stranicu apv.biosense.rs;

"BioSens", "mi", "nas" i "naši" odnosi se na Institut BioSens, naš Sajt, Aplikaciju ili našu Uslugu, zavisno od konteksta;

"Korisnik" se odnosi na Vas, na one koji koriste naše Usluge i na posetioce našeg Sajta;

"Vi" se odnosi na Vas, lice koje stupa u ovaj sporazum sa Institutom BioSens.

4. Korisnički nalog

Tokom registracije korisničkog računa tražimo da nam dostavite svoje ime, prezime i adresu elektronske pošte (e-mail). Možemo tražiti i dodatne informacije ako je potrebno. Dok koristite našu aplikaciju, možemo sakupiti dodatne informacije, poput jedinstvenog ID vašeg uređaja, IP adrese i verziju internet pretraživača koji koristite. Prilikom fotografisanja, ukoliko telefon poseduje određene senzore, prikupljamo i sledeće podatke: geografsku širinu i dužinu, nadmorsku visinu, preciznost lokacije, brzinu kretanja, poziciju i nagib telefona (bearing, azimut, roll, inclination), datum slikanja, temperaturu, vlažnost vazduha kao i pritisak.Nakon registracije, BioSens će Vam dodeliti korisničko ime. Imamo potpuno diskreciono pravo u otvaranju naloga i zadržavamo pravo odbijanja korisnika bez objašnjenjaNikada nećemo otkriti vaše lične podatke trećim licima bez vaše saglasnosti. Međutim, možemo da pružimo depersonalizovane podatke trećim licima u agregiranom obliku. Zadržavamo diskreciono pravo da ograničimo ili opozovemo vašu mogućnost da se registrujete ili da koristite AgroSens APV u bilo koje vreme.

5. Ograničena licenca i korišćenje AgroSens APV Aplikacije

Kada koristite naš Sajt, Uslugu ili našu Aplikaciju, dodeljujemo vam ličnu, ograničenu, ne-ekskluzivnu licencu za instaliranje i korišćenje našeg softvera ili aplikacije. Možemo našu Aplikaciju učiniti dostupnom na našem sajtu ili drugde, kao što su prodajna mesta trećih lica posvećena promociji i prodaji aplikacija. Imate pravo da preuzmete jednu kopiju aplikacije po ceni koja je navedena, ako ista postoji.

Kada koristite našu Uslugu ili Aplikaciju dobijate dozvolu samo za ličnu upotrebu. Kada koristite našu aplikaciju, sajt ili uslugu, preuzimate punu odgovornost za vašu upotrebu i slažete se da ga ne koristite na načine koje AgroSens APV nije izričito odobrio. Vi ste odgovorni za korišćenje AgroSens APV, kao i za svaku upotrebu AgroSens APV napravljenu pomoću vašeg naloga. Slažete se da ne pristupate, kopirate ili na drugi način koristite AgroSens APV, uključujući našu intelektualnu svojinu i zaštitne znakove, osim ako to nije odobreno ovim Uslovima korišćenja ili ako je drugačije ovlašćeno u pisanom obliku od strane Instituta BioSens. Korišćenjem našeg Sajta i Usluge slažete se sa sledećim:

• Slažete se da ne šaljete bilo šta što je nezakonito, uznemirujuće, štetno za reputaciju, pornografsko, nepristojno, uvredljivo, opsceno, širi mržnju ili rasizam, predstavlja zlostavljanje ili na neki drugi način predstavlja ponašanje neprihvatljivo našem razumnom mišljenju;

• Slažete se da pružate istinit i precizan sadržaj;

• Slažete se da ne kršite bilo koji sporazum, pravila ili smernice koje regulišu upotrebu vašeg mobilnog uređaja, u skladu sa uputstvima vašeg bežičnog operatera i / ili proizvođača mobilnog uređaja;

• Slažete se da ne prenosite bilo koji zlonamerni ili neželjeni softver;

• Slažete se da ne predstavljate neku osobu ili entitet, koristite fiktivno ime ili pogrešno predstavite svoju pripadnost osobi ili entitetu;

• Slažete se da ne kršite bilo koji zahtev, postupak, smernice ili propise mreža povezanih sa AgroSens APV ili BioSensom;

• Slažete se da se nećete mešati u rad ili opstruirati rad AgroSens APV;

• Slažete se da ne hakujete, ne spamujete ili preko mreže ugrožavate identitet nas ili drugih korisnika;

• Slažete se da delujete u granicama uobičajene pristojnosti kada koristite našu veb stranicu;

• Slažete se da ne predstavljate neku osobu ili entitet ili pogrešno predstavljate svoju vezu sa osobom ili entitetom;

• Slažete se da ne sakupljate ili čuvate lične podatke o drugim krajnjim korisnicima;

• Slažete se da ne kršite bilo koji zakon ili propis i da ste Vi isključivo odgovorni za takve prekršaje;

• Slažete se da ne kopirate, menjate, iznajmljujete, dajete pod zakup, pozajmljujete, prodajete, dodeljujete, distribuirate, primenjujete obrnuto inženjerstvo (reverse engineering), dodeljujete bezbednosni interes ili drugačije prenosite bilo kakvo pravo na tehnologiju ili softver na kom su zasnovani Aplikacija, Sajt ili bilo koje naše usluge;

• Slažete se da ne uzrokujete ili ne pomažete u cilju uništenja, manipulacije, uklanjanja, onemogućavanja ili oštećenja bilo kog dela našeg veb sajta, uključujući i deindeksiranje ili dešifrovanje bilo kog deo našeg Sajta sa sajta trećih lica, kao što je traženje njegovog uklanjanja iz pretraživača;

• Slažete se da ne kršite našu intelektualnu svojinu, osim ako imate našu dozvolu da je koristite na specifičan način na koji ste je koristili;

Ako ste otkriveni u preduzimanju bilo koje od gore pomenutih akcija, vaše povlastice za korištenje naše usluge mogu se, po našem nahođenju, prekinuti ili obustaviti. U opštem slučaju ćemo vam dati objašnjenje za bilo kakvo sankcionisanje ili prekid Vaše upotrebe bilo koje od naših usluga, ali BioSens zadržava pravo da sankcioniše ili prekine bilo koji nalog u bilo koje vreme bez prethodnog obaveštenja ili objašnjenja. AgroSens APV Sajt i Usluga mogu sadržati veze sa drugim sajtovima (kao što su reklame), integrisane proizvode trećih lica ili drugima dozvoliti da vam pošalju takve veze. Veza sa veb stranicom trećeg lica ne znači da mi dati sadržaj podržavamo ili da smo povezani sa njim. Mi ne vršimo kontrolu nad sajtovima trećih lica. Vaš pristup takvim veb stranicama ili sadržaju na stranicama trećih lica je na Vaš sopstveni rizik i uvek morate pročitati uslove korišćenja i politiku privatnosti veb stranice treće strane pre nego što je upotrebite. BioSens i AgroSens APV neće biti odgovorni za bilo kakvu štetu ili gubitak koji je posledica korišćenjem bilo kog sadržaja, robe ili usluga dostupnih sa sajta trećeg lica.

6. Prava intelektualne svojine

Dizajn AgroSens APV servisa zajedno sa BioSensovim tekstovima, skriptima, grafikom, interaktivnim funkcijama i zaštitnim znakovima, servisnim znakovima i logotipima sadržanim u njemu ("Oznake"), su u vlasništvu BioSens Instituta ili su licencirani BioSense Institutu i predmet su autorskih prava i drugih prava intelektualne svojine u skladu sa zakonima Srbije i međunaordnim zakonima i konvencijama. BioSens zadržava sva prava koja nisu izričito odobrena Uslugom ili na Sajtu. Slažete se da ne učestvujete u korišćenju, kopiranju ili distribuciji bilo čega sadržanog u okviru Sajta ili Usluge osim ako smo za to dali izričito pismeno odobrenje.

7. Sadržaj

Kada pošaljete bilo koji sadržaj putem AgroSens APV, Vi dajete BioSensu i njegovim podružnicama i predstavnicima ne-ekskluzivnu, potpuno plaćenu, trajnu, besplatnu, univerzalnu, prenosivu licencu za prikazivanje, javno izvođenje, distribuciju, skladištenje emitovanje, prenos, reprodukciju, modifikovanje, pripremu derivata i sve drugi načine korišćenja i ponovnog korišćenja celokupnog ili dela vašeg sadržaja i svega što možemo napraviti sa vašim sadržajem putem AgroSens APV ili bilo kojeg drugog medijuma koji trenutno postoji ili će postojati u budućnosti, pod uslovom da smo iste prethodno anonimizovali ili agregirali. Zadržavamo pravo prikazivanja reklama u vezi sa vašim sadržajem i korišćenja Vašeg sadržaja za oglašavanje i promociju AgroSens APV. Od nas se ne zahteva hostovanje, prikazivanje ili distribucija bilo kog sadržaja i mi možemo odbiti da prihvatimo ili prenesemo sadržaj, i možemo ukloniti ili izbrisati sadržaj AgroSensa u bilo kom trenutku.

8. Plaćanje i refundiranje

Osnovne funkcionalnosti AgroSensa su besplatne za poljoprivrednike. AgroSens APV može korisnicima ponuditi dodatne funkcionalnosti za koje se zahteva plaćanje. U takvim slučajevima, nakon registracije za dodatnu funkcionalnost AgroSens APV, bićete obavešteni o pridruženim troškovima i od Vas će biti zatraženo da izvršite plaćanje u dogovornoj formi. Cena za korišćenje dodatnih funkcionalnosti AgroSens APV, Sajta i Usluga može se menjati. Prilikom plaćanja molimo proverite da li razumete cenu i uslove plaćanja. Zadržavamo pravo da u svakom trenutku podignemo cene usluga; Međutim, obavestićemo vas o povećanju cena. Vaše informacije mogu biti obelodanjene u procesu plaćanja trećem licu za obradu plaćanja.

9. Zastupanje i garancije

Ne dajemo nikakve izjave ili garancije u pogledu prodaje naše usluge ili njene pogodnosti za bilo koju određenu namenu. Slažete se da nas oslobađate od bilo koje odgovornosti koju bismo mogli imati u vezi sa ovim sporazumom ili našim uslugama, iz razloga koji uključuju, ali ne ograničavaju se na, neuspeh naše usluge, nemarnost ili bilo koji drugi prekršaj. U meri u kojoj važeći zakon ograničava ovo oslobađanje odgovornosti, slažete se da prema vama možemo biti odgovorni samo za minimalni iznos štete propisan zakonom, ako takav minimum postoji.

Slažete se da na bilo koji način ne odgovaramo za štetu koju prouzrokuju treća lica koja mogu koristiti naše usluge, uključujući, ali ne ograničavajući se na ljude koji krše prava intelektualne svojine, čine klevetu, ometaju ekonomskih odnosa ili vrše bilo kakve druge prekršaje prema vama.

Nismo odgovorni za bilo kakav neuspeh roba ili usluga našeg Instituta ili treće strane, uključujući bilo kakve kvarove ili poremećaje, neblagovremenu isporuku, planiranu ili neplaniranu, namernu ili nenamernu, na našoj veb stranici koja onemogućava pristup našoj veb lokaciji privremeno ili trajno.

Pružanje naše usluge Vama zavisi od Vaše saglasnosti sa ovim i svim drugim delovima ovog Sporazuma. Ništa u odredbama ovog člana ("Zastupanje i garancije") se neće tumačiti kako bi se ograničila generalnost prvog stava ovog člana.

10. Ograničenja odgovornosti

Ni u kom slučaju BioSens, njegovi službenici, direktori, zaposleni ili agenti neće biti odgovorni za bilo kakvu direktnu, indirektnu, slučajnu, posebnu, kaznenu ili posledičnu štetu koja je rezultat bilo koje (i) greške, omaške ili netačnosti sadržaja , (ii) lične povrede ili imovinske štete, bilo kakve prirode, koja je rezultat vašeg pristupa i korišćenja naših usluga, (iii) bilo kakvog neovlašćenog pristupa ili korišćenja naših servera i/ili bilo kojeg ili svih ličnih podataka i/ili (iv) bilo kakvog ometanog ili prekinutog prenosa ka ili od naših usluga, (iv) bilo kojih skrivenih ili vidljivih nedostataka, bagova, virusa, trojanaca i slično, koji se mogu preneti na ili preko naših usluga od strane trećeg lica, i/ili (v) bilo kakve greške ili propusta u bilo kojem sadržaju ili za bilo koji gubitak ili štetu bilo koje vrste koja je nastala kao rezultat vaše upotrebe bilo kog sadržaja koji je objavljen, emitovan, prenet ili na drugi način stavljen na raspolaganje preko naših usluga ili sajta, bilo na osnovu garancije, sporazuma, bespravno ili na bilo koji drugi način, i bez obzira da li je preduzeće upoznato sa mogućnošću takve štete ili ne. Prethodno ograničenje odgovornosti primjenjivaće se u najvećoj meri dozvoljenoj zakonom.

Vi konkretno potvrđujete da BioSens neće biti odgovoran za sadržaj ili klevetu, uvredljivo ili nezakonito ponašanje bilo kog trećeg lica i da rizik od štete od navedenog potpada u celosti na vas.

U slučaju bilo kakvog problema sa ovim veb sajtom, uslugom ili bilo kojim sadržajem, slažete se da će Vaš jedini lek biti prestanak korišćenja ove Aplikacije odnosno Usluge. U slučaju bilo kakvog problema sa proizvodima ili uslugama koje ste kupili na našem veb sajtu ili preko njega, slažete se da će vaš jedini lek, ako postoji, biti da prekinete da koristite naš sajt. BioSens nije odgovoran prema Vama ili trećim licima zbog bilo kakve štete, povrede ili potraživanja koja proizilazi iz Vaše upotrebe bilo kog proizvoda preuzetog ili kupljenog sa naše stranice.

Za vašu pogodnost, u nastavku su navedeni neki važni detalji ovog Sporazuma koji utiču na Vaša prava i pravni lekovi:

1. Mi ne preuzimamo nikakvu odgovornost za bilo koji sadržaj korisnika koji je postavljen, uskladišten, poslat ili prenet nama, ili za bilo koji gubitak ili štetu koja može nastati kao posledica sadržaja korisnika, uključujući, ali ne ograničavajući se na klevete, uvrede, neistine, opscenost ili nepristojnost;

2. Ne preuzimamo nikakvu odgovornost za bilo koji zahtev, radnju, molbu, zahtev za arbitražu ili tužbu u vezi sa povredom ili štetom koja proizilazi iz bilo kog ili kakvog korišćenja AgroSens APV, pravnog ili bespravnog;

3. Vaša sposobnost da koristite ili interagujete sa ovim sajtom je privilegija, a ne pravo, a mi zadržavamo pravo da po našem isključivom izboru preduzmemo bilo koju radnju koju smatramo pravilnom, bez prethodne najave, kako bi sprečili bilo kakvo kršenje, sproveli bilo kakve odredbe ili ispravili bilo kakva navodna kršenja ovog Sporazuma ili bilo kog važećeg zakona.

BioSens neće biti odgovoran iz bilo kog razloga ili za štetu, čak i ako smo upozoreni na mogućnost takve štete. U slučaju da je ova klauzula zabranjena ili ograničena važećim zakonom, naša odgovornost će biti ograničena na najniži zakonski potreban iznos. BioSens ne tvrdi da je Usluga odgovarajuća ili dostupna za korišćenje na drugim lokacijama. Oni koji pristupaju ili koriste Uslugu iz drugih pravnih Sistema to rade po sopstvenoj volji i odgovorni su za poštovanje lokalnog prava.

11. Obeštećenje

Slažete se da branite, obezbedite i štitite BioSense, njegove službenike, direktore, zaposlene i agente od i protiv svih potraživanja, šteta, obaveza, gubitaka, obaveza, troškova ili duga i troškova (uključujući, bez ograničenja, advokatske takse) koji proizilaze iz: (i) Vaše upotrebe i pristupa AgroSens Sajtu i Uslugama; (ii) Vaše povrede bilo koje tačke ovog Sporazuma; (iii) Vaše povrede bilo kog prava trećeg lica, uključujući bez ograničenja bilo koje autorsko pravo, imovinu ili pravo privatnosti; ili (iv) bilo koje tvrdnje da je bilo koji od Vaših sadržaja prouzrokovao štetu trećem licu. Ova obaveza odbrane i obeštećenja će nadživeti ovaj Sporazum i vašu upotrebu AgroSens servisa.

Takođe se slažete da imate dužnost da nas branite protiv takvih zahteva i da u takvim slučajevima možemo zatražiti od vas da platite advokate po našem izboru. Slažete se da se ovo obeštećenje proširuje na zahtev da platite za naše razumne advokatske troškove, sudske troškove i isplate. U slučaju zahteva kao što je opisano u ovom stavu, možemo izabrati da se dogovorimo sa strankom / strankama koje podnose zahtev i Vi ćete biti odgovorni za štetu kao da je suđenje nastavljeno.

12. COPPA saglasnost

AgroSens APV i njegove usluge mogu koristiti samo lica starija od 18 godina. AgroSens APV ni na koji način ne cilja na decu. Ako ste mlađi od 18 godina, molimo Vas da ne koristite naš veb sajt niti usluge i ne dostavljate nam nikakve informacije.

13. Izbor zakona

Ovaj sporazum uređuje se zakonima Republike Srbije.

14. Nadležnost

U slučaju da je nemoguće rešiti spor dogovornim putem, bilo kakav spor, polemika ili kontroverze u vezi sa ovim Sporazumom, uključujući sva pitanja koja se tiču njegovog postojanja, važenja ili završetka, biće u nadležnosti Osnovnog suda u Novom Sadu, Srbija

15. Viša sila

Slažete se da nismo odgovorni prema vama za bilo šta za šta smo inače odgovorni, ako je to rezultat događaja izvan naše kontrole, uključujući, ali ne ograničavajući se na višu silu rat, pobunu, nerede, terorizam, kriminal, nedostatak radne snage (uključujući zakonite i nezakonite štrajkove), embargo, poremećaj poštanskog saobraćaja, poremećaj komunikacija, neuspeh ili nedostatak infrastrukture, nedostatak materijala ili bilo koji drugi događaj izvan naše kontrole.

16. Opterećenje

U slučaju da se utvrdi da je odredba ovog Sporazuma nezakonita, u suprotnosti sa drugom odredbom Sporazuma ili da ju je na drugi način nemoguće ispuniti, Sporazum će ostati na snazi kao da je sklopljen bez te odredbe. Ako se dve ili više odredbi ovog Sporazuma smatraju suprotnim jedna drugoj, BioSens ima jedino pravo da izabere koja odredba ostaje na snazi.

17. Neodricanje

Zadržavamo sva prava koja nam pripadaju prema odredbama ovog sporazuma kao i prema odredbama važećih zakona. Naše neizvršavanje bilo koje posebne odredbe ili odredbi ovog sporazuma ili bilo kog važećeg zakona ne treba tumačiti kao naše odricanje od prava na izvršenje iste odredbe pod istim ili različitim okolnostima u bilo koje vreme u budućnosti.

18. Prestanak važenja i raskid sporazuma

Možemo prekinuti ili obustaviti Uslugu ili Vaš nalog ili bilo koju drugu uslugu koju pružamo Vama po našem nahođenju bez objašnjenja i obaveštenja, mada ćemo nastojati da u većini slučajeva pružimo blagovremeno objašnjenje. Ako želite da raskinete ovaj Sporazum, Vi ste isključivo odgovorni za praćenje odgovarajućih procedura prekida. Otkazivanje može dovesti do brisanja bilo kog sadržaja koji ste dostavili AgroSens APV. Sve odredbe ovog Sporazuma, koje po svojoj prirodi treba da nadžive prestanak, nadživeće prekid, uključujući, bez ograničenja, odredbe o vlasništvu, odricanja od garancije, obeštećenje i ograničenja odgovornosti.

19. Zadatak

U skladu sa ovim Sporazumom ne možete dodeliti vaša prava i/ili obaveze bilo kojoj drugoj strani bez naše prethodne pismene saglasnosti. Naša prava i/ili obaveze prema ovom Sporazumu možemo dodeliti bilo kojoj drugoj strani po našem nahođenju.

20. Amandmani

S vremena na vreme možemo izmeniti ovaj Sporazum. Prilikom izmene ovog Sporazuma ažuriraćemo samo ovu stranicu i naznačiti datum kada je izvršena poslednja izmena. Možete odbiti da se složite sa amandmanima, ali ako to učinite, morate odmah prestati da koristite naš Sajt i naše Usluge. Morate posetiti ovu stranicu svaki put kada dođete na našu veb stranicu i pročitati je i složiti se sa sadržajem ako je datum poslednje izmene kasniji u odnosu na datum kada ste se poslednji put složili sa Sporazumom.

21. Odvojeni sporazumi

User Agreement

1. Your Acceptance

This is an agreement (“Agreement”) between BioSense Institute (“BioSense”), the owner and operator of apv.biosens.rs and .apv.biosense.rs, the AgroSens APV software, the AgroSens APV mobile applications and you (“you,” “your” or “user(s)”), a user of the our website or service. Throughout this document, the words “BioSense”, “us,” “we,” and “our,” refer to us, BioSense Institute, our site and service apv.biosense.rs (“Site” or “Service”), or our app, AgroSens APV (“App”), as is appropriate in the context of the use of the words.

Please read the Terms of Service and the Privacy Policy before using our Site and Service. This Agreement is legally binding and governs your use of our App, Site and Service. By using or accessing any part of our Site or Service you agree to be bound by these Terms of Service and the Privacy Policy.

We may amend our Terms of Service or Privacy Policy from time to time and we ask you to check this page as this Agreement or our Privacy Policy may have changed. Your continued use of our App, Site or Service will constitute acknowledgement and consent to any amendments made within the Privacy Policy and Terms of Service.

If you do not agree to the Terms of Service or the Privacy Policy please cease using our Site and Service immediately. Users of our Service must be above the age of 18. If you are under the age of 18 please stop using our Site and Service immediately and do not submit any information to us.

2. AgroSens APV Description of Service

AgroSens APV provides online and mobile tools for farmers, agricultural companies, governmental bodies and academic and research institutions involved in agriculture. We provide record keeping, paperless tracking and processed Sentinel satellite imagery. In addition, we provide data visualisation tools, weather updates and various additional information that helps better manage agricultural operations.

3. Definitions

Throughout this Agreement, we may use certain words or phrases, and it is important that you understand the meaning of them. The list is not all-encompassing and no definition should be considered binding to the point that it renders this Agreement nonsensical:

“Agreement” means these Terms of Service;

“App” means the AgroSens APV application for mobile devices that we may make available through our Site or a third party app store or site, offering similar features to those available on our Site;

“Service” refers to the services that we provide through our Site, as well as any Software and our App;

“Site” refers to our website apv.biosense.rs ;

“BioSense” “us,” “we,” and “our,” refers to our company BioSense Institute, our Site, App or our Service, depending on the context of the usage;

“User” refers to you, those who use our Services, and general visitors to our Site;

“You” refers to you, the person who is entering into this Agreement with BioSense Institute.

4. User Accounts

During account registration we require that you provide us with your name and e-mail. We may also require additional information from you if necessary. When downloading our App we may collect additional information such as your Unique Device ID or IP address, version of the internet browser you are using. When photographing, if sensors are attached to the phone, we also collect the following data: latitude and longitude, altitude, location, speed of motion, position and inclination of the phone (bearing, azimuth, roll, inclination), image date, air temperature, humidity and pressure.

After registering, BioSense will provide you with a username. We have the final discretion in granting accounts and reserve the right to reject users without explanation.

We will never disclose your personally identifying information to third parties without your consent. However, we may provide non-identifying information to third parties in an aggregate form. We may at our discretion restrict, limit or revoke your ability to register or use AgroSens APV at any time.

5. Limited License and Use of AgroSens APV

When using any of our Site, Services or our App, we grant you a personal, limited, non-exclusive license to install and use our software or application. We may make our App available on our Site or elsewhere, such as a third party store dedicated to the promotion and sale of apps. You are given the right to download one copy of the App at the price listed, if any.

When you use our Service or App you are granted a license only for your personal use. This means that you cannot sell our Service or App anywhere else, share your license with anyone else, reverse engineer or otherwise attempt to copy our Service or App, or try and make money off it without our express written permission. Even if we offer our Service or App for free, you must still abide by these provisions and not copy or otherwise use our App in a manner prohibited by this section. You obtain no ownership rights when you purchase and download any software or our App, but are instead buying (or, in the case of a free download, being given) a license to install and use our software or App within the confines of this Agreement.

When using our App, Site or Service, you assume full responsibility for your use and agree not to use it in ways not explicitly authorized by AgroSens APV. You are responsible for your use of AgroSens APV, and for any use of AgroSens APV made using your account. You agree not to access, copy, or otherwise use AgroSens APV, including our intellectual property and trademarks, except as authorized by these Terms of Service or as otherwise authorized in writing by BioSense. By using our Site and Service you agree to the following:

• You agree not to transmit anything that is illegal, abusive, harassing, harmful to reputation, pornographic, indecent, profane, obscene, hateful, racist, or otherwise objectionable in our reasonable opinion;

• You agree to provide truthful and accurate content;

• You agree not to violate any contract, rules or policies that govern the use of your mobile device, as directed by your wireless carrier and/or mobile device manufacturer;

• You agree not to transmit any malicious or unsolicited software;

• You agree not to impersonate any person or entity, use a fictitious name, or misrepresent your affiliation with a person or entity;

• You agree not to violate any requirements, procedures, policies or regulations of networks connected to AgroSens APV or BioSense;

• You agree not to interfere with or disrupt AgroSens APV;

• You agree not to hack, spam or phish us or other users;

• You agree to act within the bounds of common decency when using our website;

• You agree not to impersonate any person or entity or misrepresent your affiliation with a person or entity;

• You agree not to collect or store personal information about other end users;

• You agree to not violate any law or regulation and you are solely responsible for such violations;

• You agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying our App, Site or any of our Services;

• You agree not to cause or aid in the cause of the destruction, manipulation, removal, disabling, or impairment of any portion of our website, including the de-indexing or de-caching of any portion of our website from a thira party’s website, such as by requesting its removal from a search engine;

• You agree not infringe upon our intellectual property unless you have our permission to use it in the specific manner that you used it;

• You are expressly prohibited from accessing AgroSens APV through a virtual private network or by proxy.

If you are discovered to be undertaking any of the aforementioned actions your privileges to use our Service may at our discretion be terminated or suspended. Generally, we will provide an explanation for any suspension or termination of your use of any of our Services, but BioSense reserves the right to suspend or terminate any account at any time without notice or explanation.

The AgroSens APV Site and Service may contain links to other websites (such as in advertisements), integrated third party products or allow others to send you such links. A link to a third party’s websitedoes not mean that we endorse it or that we are affiliated with it. We do not exercise control over third-party websites. Your access to such third-party websites or content shall be at your own risk, and you should always read the terms of use and privacy policy of a third-party website before using it. BioSense or AgroSens APV shall not be responsible for any damages or loss related to the use of any contents, goods or services available on or through any third-party website.

6. Intellectual Property Rights

The design of the AgroSens APV Service along with BioSense created text, scripts, graphics, interactive features and the trademarks, service marks and logos contained therein (“Marks”), are owned by or licensed to BioSense Institute, subject to copyright and other intellectual property rights under law of Serbia and foreign laws and international conventions. BioSense reserves all rights not expressly granted in and to the Service and the Site. You agree to not engage in the use, copying, or distribution anything contained within the Site or Service unless we have given express written permission.

7. Content

When you send any content through AgroSens APV, you grant BioSense and its affiliates, representatives and assigns a non-exclusive, fully-paid, perpetual, royalty-free, world-wide, universal, transferable license to display, publicly perform, distribute, store, broadcast, transmit, reproduce, modify, prepare derivative works and otherwise use and reuse all or part of your content and anything we may make with your content through AgroSens APV or any other medium currently invented or invented in the future, provided it has been anonimized or aggregated. We reserve the right to display advertisements in connection with your content, and to use your content to advertise and promote AgroSens APV.

We are not required to host, display, or distribute any content, and we may refuse to accept or transmit content, and may remove or delete content from AgroSens APV at any time.

8. Payment and Refunds

Basic functionalities of AgroSens APV are free for farmers. AgroSens APV might offer additional billable functionalities. In such cases, after registering for an AgroSens APV additional functionality, you will be notified about the associated costs and will be asked to submit payment in the agreed form. The price to use AgroSens APV additional functionalities, Site and Service may vary. When paying please verify that you understand the price and the terms and conditions of payment. We reserve the right to raise our monthly rates at any time; however, we will provide you with notice of the fee increase. Your information may be disclosed to our third party payment processor to process payments.

9. Representations and Warranties

We make no representations or warranties as to the merchantability of our service or fitness for any particular purpose. You agree that you are releasing us from any liability that we may otherwise have to you in relation to or arising from this agreement or our services, for reasons including, but not limited to, failure of our service, negligence, or any other tort. To the extent that applicable law restricts this release of liability, you agree that we are only liable to you for the minimum amount of damages that the law restricts our liability to, if such a minimum exists.

You agree that we are not responsible in any way for damages caused by third parties who may use our services, including but not limited to people who commit intellectual property infringement, defamation, tortious interference with economic relations, or any other actionable conduct towards you.

We are not liable for any failure of the goods or services of our company or a third party, including any failures or disruptions, untimely delivery, scheduled or unscheduled, intentional or unintentional, on our website which prevent access to our website temporarily or permanently.

The provision of our service to you is contingent on your agreement with this and all other sections of this agreement. Nothing in the provisions of this “representations & warranties” section shall be construed to limit the generality of the first paragraph of this section.

10.Limitations on Liability

In no event shall BioSense, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our services, (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our services by any third party, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the services, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

You specifically acknowledge that BioSense shall not be liable for content or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

In the event of any problem with this web site or any content, you agree that your sole remedy is to cease using this web site. In the event of any problem with the products or services that you have purchased on or through this web site, you agree that your sole remedy, if any, is to terminate use of our site. BioSense is not liable to you or to third parties for any damage, harm, injury or claim that arises from your use of any products purchased from our site.

For your convenience, the following are some important details of this Agreement that affect your rights and remedies:

1 We take no responsibility and assume no liability for any user content that is posted, stored, uploaded, or transmitted to us, or for any loss or damages that may occur because such member content including, but not limited to defamation, slander, libel, falsehoods, obscenity, or profanity;

2 We take no responsibility and assume no liability for any claim, action, petition, demand for arbitration or lawsuit alleging injury or damage resulting from any use of AgroSens APV, whether arising in tortor contract, law or equity;

3 Your ability to use or interact with this website is a privilege, not a right, and we reserve the right to take any action that we deem proper, without notice, to prevent any violation, enforce any provision, or rectify any alleged violations of this Agreement or any applicable law at our sole discretion.

BioSense shall not be liable for any other reason or for damages, even if we have been advised of the possibility of such damages. In the event that this clause is prohibited or restricted by applicable law, our liability shall be limited to the lowest legally required amount. BioSense makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

11. Indemnity

You agree to defend, indemnify and hold harmless BioSense, its officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: (i) your use of and access to the AgroSens APV Site and Service; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that any of your content caused damage to a third party. This defense and indemnificationobligation will survive these Terms of Service and your use of the AgroSens APV Service.

You also agree that you have a duty to defend us against such claims and we may require you to pay for an attorney(s) of our choice in such cases. You agree that this indemnity extends to requiring you to pay for our reasonable attorneys’ fees, court costs, and disbursements. In the event of a claim such as one described in this paragraph, we may elect to settle with the party/parties making the claim and you shall be liable for the damages as though we had proceeded with a trial.

12. COPPA Compliance

AgroSens APV and its Services may only be used by persons 18 years and older. AgroSens APV in no way targets children, if you are under the age of 18 please do not use our Site and do not submit any information to us.

13. Choice of Law

This Agreement shall be governed by the law of Serbia.

14. Forum of Dispute

Should it be impossible to resolve the dispute by means of negotiations, any dispute, controversy, or claim arising out of, or run connection with this Agreement, including any questions regarding its existence, validity or terminations, shell be referred to and finally resolved by the Primary court in Novi Sad, Serbia, under its Rules which is deemed to be incorporated by reference into this clause.

15. Force Majeure

You agree that we are not responsible to you for anything that we may otherwise be responsible for, if it is the result of events beyond our control, including, but not limited to, acts of God, war, insurrection, riots, terrorism, crime, labor shortages (including lawful and unlawful strikes), embargoes, postal disruption, communication disruption, failure or shortage of infrastructure, shortage of materials, or any other event beyond our control.

16. Severability

In the event that a provision of this Agreement is found to be unlawful, conflicting with another provision of the Agreement, or otherwise unenforceable, the Agreement will remain in force as though it had been entered into without that unenforceable provision being included in it.

If two or more provisions of this Agreement are deemed to conflict with each other’s operation, BioSense shall have the sole right to elect which provision remains in force.

17. Non-Waiver

We reserve all rights permitted to us under this Agreement as well as under the provisions of any applicable law. Our non-enforcement of any particular provision or provisions of this Agreement or the any applicable law should not be construed as our waiver of the right to enforce that same provision under the same or different circumstances at any time in the future.

18. Termination and Cancellation

We may terminate or suspend service or your account or any other provision of services to you at our discretion without explanation and notice, though we will strive to provide a timely explanation in most cases. If you wish to terminate this Agreement, you are solely responsible for following proper termination procedures. Cancellation may result in the immediate deletion of any content that you have submitted to AgroSens APV. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

19. Assignment

You may not assign your rights and/or obligations under this Agreement to any other party without our prior written consent. We may assign our rights and/or obligations under this Agreement to any other party at our discretion.

20. Amendments

We may amend this Agreement from time to time. When we amend this Agreement, we will update this page and indicate the date that it was last modified. You may refuse to agree to the amendments, but if you do, you must immediately cease using our website and our Service. You must visit this page each time you come to our website and read and agree to it if the date it was last modified is more recent than the last time you agreed to the Agreement.

21. Separate Agreements

It might be a case when separate agreement between BioSense and user is concluded. Terms and Conditions or Privacy Policy signed between BioSense and user in such agreement prevail over the Terms and Conditions or Privacy Policy disclosed on the Site.
